The criminal justice system in our country has come under increased scrutiny in recent years by  academics, the media and the general public. Many of the criticisms deal with the way in which minority group members have been treated by the three branches of the criminal justice system, namely, the police, the courts and the correctional system.

This assignment asks you to select one group of Canadians that has experienced racism, discrimination, prejudice or some other form of mistreatment at the hands of one of the the branches of our justice system. Examples of groups that have experienced these problems include, but are not limited to visible minority groups, Indigenous peoples, and members of  the LBTG community. Your paper should document recent problems/complaints against the particular branch of the CJS that you have chosen. Also, please document what, if anything is being done or has been done to rectify these issues.

Racism remains a key challenge in the Canadian police force. The Canadian criminal justice system has been subjected to widespread condemnation regarding the manner by which it handles people of colored ethnicities. Indigenous and African Canadian communities raised a lot of concern regarding systematic racism and incidences of police brutality. The ill treatment faced by Canadian blacks is depicted by several widespread protests that have rocked the nation.

The protests have called for the nation’s criminal justice system to make amendments in order to create social equality in regards to the treatments of the population when dealing with the police. The argument that the Canadian police are racially discriminative against blacks is illustrated by diverse cases of oppression against this particular population and measures being taken by the government to address the issue.

Racial discrimination against blacks is illustrated by the harsh treatment they are subjected to by the police. The Canadian police is depicted as more likely to harass blacks compared to individuals of other races. Witness’s accounts had pointed out having seen violent incidences at the time of Manon’s arrest. Furthermore, postmortem results indicated that the teenager had died from lack of adequate breath due to exertion of force on the back. The events therefore affirms the claim that Canadian police discriminate against blacks. The discrimination is depicted by the harsh treatment blacks go through at the hands of the police compared to other citizens.

The racial discriminative nature of the Canadian police is also indicated by the high death prevalence of black suspects compared to whites at the hands of the law enforcers. Different statistical reports indicate that blacks are more likely to die at the hands of the police than whites.  The Ontario Human Rights Commission for instance, established that massive cases racial discrimination had rocked the country’s police unit. The revelations were made using a 2018 report that documented instances of civilian deaths under the police. The report’s analysis determined that blacks were more likely to die in the hands of the police.

In particular, blacks were depicted as being at 20% more likely to die at the hands of the police compared to whites. The above statements reflects the report’s findings on Toronto. The shocking details of the findings were illustrated by the black’s population in city. While black comprised only 8.8% of the city’s population, their percentage being victims of police brutality was way higher than that of people of other ethnicities. For instance, blacks accounted for 61% of all cases where the police use of force had led to the death of the suspects.

Likewise, 71% of the cases where the police were involved in shooting incidences thus resulting to fatalities involved blacks. The fact that blacks find themselves as comprising a large number of deaths at the hands of the police despite their small population serves as an indication that something is wrong with the Canada’s police. The situations provides reflections of a racially biased police force that targets blacks hence leading their deaths.

Likewise, the discriminatory nature against blacks by the Canadian police is illustrated by concerns for the high incidences of inspections. Racial discrimination is often associated with diverse negative stereotypes that the society develops about a particular ethnic group.  An example of a racial stereotype is seen in the belief that whites are superior to blacks. Likewise, there is a stereotypic belief that blacks are more likely to engage in crime.

While stereotypes tend to be normal, their detrimental effects are seen in them leading to discrimination. A perfect case of the discriminative nature of stereotypes is seen in the Canadian police’ ill judgement of blacks.  The police have been blamed for subjecting blacks to unnecessary and unjustified inspections.  A study by city of Montreal established the existence of systemic racism in regards to stoppage inspections.

The report that focused on police stoppages data from 2014 to 2017 determined that blacks and indigenous people were more likely to be stopped by the police compared to whites. In particular, blacks and indigenous people were depicted as having 4 to 5 times possibilities of being stopped by the police (Yoon and Bernstien, 2019). The constant stoppages of blacks illustrates the criminal mentality that the police have about them. The police consider blacks as more likely to engage in crime thereby discriminating them for inspections.

Several recommendations have been enacted as means to solve cases of racial discrimination by the police. The Neighborhood policy is one such program. The policy seeks to enhance better relationship between the police and community members. The program’s need is based on the perception that the police have limited knowledge about certain communities such as blacks and indigenous people.

The lack of understanding by the police on the people therefore leads to racial discrimination. The Neighborhood policy therefore seeks to train the police on how to live with different communities.  The training is followed by a 4 year posting in the same community. The objective of the program is to lower racial discrimination through collaborative efforts.

Another approach to minimizing cases of racial discrimination by the police is by enlightening the involved parties of their rights conduct. Lack of understanding between the police and suspects is considered one of the factors that contribute to the detrimental effects between the police and suspects. A clear understanding of the criminal justice rules is depicted as the ideal avenue to solve the misunderstandings. Different human rights organizations have come out to educate the citizens, more so, colored people on the significance of reason out with the police on the basis of their rights. Similarly, the police have been urged to make rational decisions.
