Human services workers should not be accountable for clients’ suicide. However, the workers are only held responsible if they engage in malpractices under the wrongful death lawsuits. Therefore, for the claimants to win the lawsuit, they must prove the following elements; breach of duty, duty, causation, and damages.
Human services workers rehabilitate, counsel, reform, and offer psychotherapy services to individuals with mental health conditions such as suicidal thoughts and psychosis from drugs and substance use. Often, mental health patients recover while others deteriorate and end up committing suicide. In suicidal resulting circumstances, the human services cannot be held liable without potential proof of malpractice.

For the claimant to succeed in a malpractice claim, the duty element should confirm that the human service worker and the client had a professional relationship. Secondly, breach of duty determines whether the human service worker was negligent and disobeyed the code of conduct. The causation element is crucial to determine that the human services worker’s negligence led to the client’s injury and suicide. Most importantly, the claimant must demonstrate the actual damages incurred that are visible for compensation.
